The crime of sexual abuse of children seriously harms children's physical and mental health and seriously violates social ethics and morality. In recent years, cases of sexual abuse of children have aroused strong concern in the society, how to reduce the occurrence of cases of sexual abuse of children has become a hot topic.

Recently, the 2021 "Girls Protection" National Committee representative symposium hosted by the China Children's Culture and Arts Foundation, etc. was held in Beijing, "Girls Protection" 2020 sexual assault case statistics and child sexual assault education survey report (hereinafter referred to as "Report") issued at the same time.

At the symposium, several delegates suggested that sex education should be included in compulsory education, and during this year's two sessions of the National Committee of the Chinese People's Political Consultative Conference (CPPCC), Ma Xiuzhen, from Ningxia, also proposed to include sexual health education in the curriculum of secondary school students.

Experts interviewed by the Daily Law believe that strengthening children's sex education can play an important role in preventing and reducing cases of sexual abuse of children, based on the characteristics of the crime committed by acquaintances in cases of sexual abuse of children and the place where they occur. From a practical point of view, although China's sex education has made great progress compared to before, but there are still many shortcomings and misunderstandings.

Cases of sexual abuse of children by such acquaintances and even relatives are by no means a minority. According to the report, there were 332 cases of sexual abuse of children (under 18 years of age) publicly reported in the media in 2020, with 845 victims, the youngest being only one year old, and 231, or 74.04 per cent, of the 312 cases indicating interpersonal relationships. Reports in recent years indicate that the proportion of acquaintances committing crimes has been high, with the highest proportion reaching 87.87 per cent (2014).

Li Ying, deputy director and lawyer of Zhenbang Law Firm in Beijing, told the Rule of Law Daily that the high proportion of sexual assault by acquaintances has a lot to do with the children's guardians being more at ease with them and the children's awareness of their prevention. Sexual assault in the family, because of taking into account family, ethics, life security and other factors, victims often dare not call the police to defend their rights.

Li Ying said the number of cases of sexual assault against children in the report, which is only the tip of the iceberg, is only the number of cases made public by the media.

According to the Supreme Law, between 2017 and June 2019, for example, 8,332 cases of child molestation were concluded by courts across the country. Of these, 2,962 were closed in 2017, 3,567 in 2018 and 1,803 in January-June 2019.

Notably, the Report notes that 820 out of 845 children show gender, of whom 80, or 9.76 per cent, are boys.

Pi Yijun, a professor at China University of Political Science and Law and director of the Center for Juvenile Delinquency and Juvenile Justice, told the Rule of Law Daily that victims of sexual crimes are men and women. In real life, boys may also be subjected to unlawful sexual assault, which can also cause serious psychological trauma to boys, but many people are largely unsympathetic to this aspect, believing that sexual assault on children will only occur to girls.

In addition, 265 cases in the Report indicated the geographical distribution of urban and rural areas, of which 164, or 66.40 per cent, occurred in urban areas, 75 in county towns, accounting for 30.36 per cent, and in rural areas, 26, or 10.53 per cent. It can be seen that it is not "only rural children are at risk of sexual assault", whether urban children or rural children are at risk of sexual assault.

Li Ying said it is worth noting that some new forms of sexual assault, such as online sexual assault, are still serious. This form of crime is very hidden, parents are difficult to find, minors because of fear and other psychological will rarely take the initiative to tell parents. And found cases of online sexual abuse of children, often a case of dozens of victims, like South Korea's "Room N" case.

According to reports, there are three main types of sexual assault crimes committed against minors using the Internet: sexual assault after a netizen meets a minor, shooting nude videos of minors via internet chat, tricking minors into shooting obscene videos and uploading the Internet for profit.

"It's worth noting that there's also a form of sexual assault that's associated with bullying on campus, similar to forced sex, such as high school students or students who have dropped out of school, to force lower-grade students to have sex, which is already more serious, especially in small counties on the fifth and sixth lines." Such compulsive transactions may be linked to the local underground industry chain, the situation is complex and difficult to account for, but also because of the age of criminal responsibility, the age of sexual consent, lack of corresponding evidence and other issues difficult to pursue. Li Ying said.

Compared with the situation of sexual abuse of children in recent years, the sex education work in our country lags behind obviously, which is reflected in several generations. "Rule of Law Daily" reporters after reviewing the relevant cases found that some children after encountering sexual assault do not know what is going on, or because of fear, fear and other psychological dare not tell parents, serious or even produce light emotions; If children get the right sex education, whether from home or school, the number of cases of sexual assault on children will be greatly reduced, and parents and children will know how to treat them properly after sexual assault, Pi said.

The concept of sex education is in the wrong spot

In the topic discussion area of the social platform, you can see that parents who share Zhang Yan's thoughts are not in the minority.

Parents are the child's first teacher, but also the child's sex education first teacher. Wang Dawei, a professor at Chinese Min Public Security University, believes that children's lack of sex education has a lot to do with parents. "Although parents have significantly increased their awareness of child safety education in recent years, especially gender awareness education and sexual assault prevention education, some parents still believe that this is not just needed. Many books about child safety education are not selling well, and we rarely hear of any parent who specializes in making up safety education for their children, and some videos or articles about child safety education are not very popular. ”

Pi Yijun has written a book called "The Crisis of Adolescence", which mentions that the peak of adolescent transgression (usually the behavior that violates the norm, perverses common sense, immorality, sin, and law-breaking, and has a certain negative impact on society) is adolescence. "But in terms of sex education, it should start at the age of two or three, and it's up to parents. Some children make mistakes or are sexually assaulted because some parents think their children are too young to teach, leading to a serious lack of sex education in their families. Pi Yijun said.

In addition to the aforementioned avoidance, parents still have many misunderstandings about sex education. Some parents believe that sexual abuse of children is itself a small probability event, will never occur in their own children, and some parents believe that their children would have been healthy sunshine, knowing that these may be counterproductive, and therefore negative negative attitude towards sex education, and even parents believe that such child safety education may lead to physical and psychological distortions of children.

Li Ying believes that this concern reflects parents' belief that sex education is not a good thing, in fact, sex education and we eat and dress, are normal phenomenon. In a normal way, it is naturally less mysterious.

"In fact, a lot of times children don't know the specific meaning of some of their sexual exploration behavior, just out of curiosity. For some of our children's problems, if our parents are mysterious and don't tell them what's going on, they'll become more interested and learn through other channels, such as the Internet, and what they get is beyond our control. In China, the age of first sexual intercourse is getting younger, and then early pregnancy or even the birth of children is not in the minority, these lack of family sex education is not unrelated. Li Ying said. School hours are tight

There is a relative shortage of teaching materials


In the course of the interview, "Rule of Law Daily" reporter learned that from kindergarten to high school, there are not many separate sex education courses, many schools believe that these content biology classes, ideological and moral courses have been included, no longer specifically to open relevant courses, and schools only open one or two sex education courses per semester, the content of the introduction is only male and female physiological knowledge, and is separate classes for men and women.

In fact, Wang said, the state has invested a lot of energy and money at the school level. Many local administrative departments will issue free life-safety teaching materials to students, and many schools also have the Attorney General, the President of the Court, the Director of the police station, etc. as vice-principals of the legal system. In terms of current results, these have contributed significantly to children's safety education, including sex education.

"Because of tight school schedules, it is difficult to increase the number of hours even if there are materials in school; even if the school offers the appropriate courses, there are now few specialized safety training instruction courses, and many teachers do not know how to teach more scientifically and effectively even if they get them." Wang Dawei said.

The lack of sex education in schools is not only related to the school itself, but also has a lot to do with the misperception of society.

Li Ying has experienced this kind of "talking about color change" situation first-hand. She told Rule of Law Daily that sometimes she and her team go out to do sex education-themed events and suggest changing the name of the event. "Actually, the children, parents and teachers who were there all felt good after hearing it, not as everyone thought." Li Ying said.

Then some people posted out-of-the-box pictures online, making the matter increasingly controversial, and eventually the school had to withdraw the book.

In fact, this book, "Cherishing Life - Reading the Health Education of Primary School Students", was written and published by the Children's Sex Education Task Force of Beijing Normal University, and covers every stage of a child's confusion about sex from first to sixth grade, and answers can be found in the book. The only thing that has caused controversy is an illustration of the scientific name of the body organ, which is not as unattentable as it is circulating online. Not only that, but the book also tells children to prevent sexual assault, promotes the concept of gender equality, equality of life, equality in employment, and advocates that men and women should respect each other.
